 Deposit management via Swikly


1. PURPOSE AND SCOPE OF APPLICATION 

This policy specifies the terms and conditions for managing deposits in the context of short-term furnished rentals operated by Yakabook, a brand of EdenAppart, on behalf of partner owners. It defines the rules for collection, retention, partial or total debit, as well as the obligations of the traveller. This policy applies to all bookings made via the platforms or directly with Yakabook.com. 

2. DEFINITION OF THE DEPOSIT

The deposit is a financial guarantee intended to cover material damage, loss, theft, technical interventions, nuisances or any costs resulting from abnormal use of the accommodation. It is not a down payment and the amount is not debited unless a breach is found. The deposit is mandatory.

3. AMOUNT OF THE DEPOSIT

The amount applied by Yakabook is indicated in the advertisement for the accommodation concerned.

4. COLLECTION AND VALIDATION VIA SWIKLY

Swikly is a secure bank card imprint system (3D Secure). No amount is debited when the imprint is registered. The deposit must be validated within 7 days before the start of the booking. In the event of non-validation, Yakabook reserves the right to:

• Cancel the booking in accordance with the applicable Terms and Conditions

• Refuse access to the accommodation without compensation.

5. VALIDITY PERIOD OF THE IMPRINT

The bank imprint is valid:

• Up to 30 days after the departure date;

• Or until automatic expiry by Swikly according to their terms and conditions.

This period allows for the identification of any damage and the necessary repairs to be carried out.

6. REASONS FOR PARTIAL OR TOTAL CHARGES

6.1 Damage to property: furniture, walls, electrical appliances, bedding, decorations, swimming pool, spa, gate, and any equipment on the property.

6.2 Loss or damage: keys, Apple TV remote controls, parking cards, building access badges. 

6.3 Extra cleaning: accommodation left in an abnormal condition, irreparable linen, cigarette odours, rubbish not taken out.

6.4 Nuisances and disturbances: police intervention, neighbours, complaints.

6.5 Improper use: parties, exceeding capacity, failure to comply with regulations.

6.6 Technical interventions due to misuse: plumbing, electricity, appliances.

6.7 Late departures: each hour or part thereof will be charged at £50.

6.8 Theft or loss of items: replacement of missing equipment.

7. ASSESSMENT AND CHARGING PROCEDURE

In the event of damage being found:

1. A detailed report is drawn up by Yakabook or an approved service provider.

2. Evidence is systematically produced: photos, videos, quotes, invoices.

3. The traveller is informed of the proposed deduction.

4. The debit is made via Swikly for the strictly necessary amount. Yakabook never makes a debit without justification and only within the limits of the actual damage. 

8. RELEASE OF THE DEPOSIT

If no anomalies are found, the deposit is automatically released: • Within 7 days after departure;

• Or upon automatic expiry by Swikly.

No action is required on the part of the traveller.

9. REFUSAL OR INABILITY TO PROVIDE THE DEPOSIT

If the deposit is not validated:

• The traveller will not be able to access the accommodation;

• The booking may be cancelled without refund in accordance with the applicable cancellation policy;

• Yakabook will not bear any costs related to the refusal to provide the deposit.

10. DISPUTES

Any disputes must be sent to: exploitation@eden-a.com. The information provided will be examined and a response will be provided within a reasonable time frame.

11. CONFIDENTIALITY AND PERSONAL DATA

Bank details are never disclosed to or stored by Yakabook. They are processed exclusively by Swikly, in accordance with the GDPR and PCI DSS standards. Yakabook only receives:

• Confirmation of the deposit validation; • The guaranteed amount;

• Notifications of any debits.

12. ACCEPTANCE

All bookings imply acceptance of this Deposit Policy, which supplements the General Terms and Conditions of Sale.
